GENERAL TERMS AND CONDITIONS
1. General purchase terms
These Specific Conditions of the Purchase Contract apply to online sales made through the website www.aristocrazy.com (hereinafter, the WEBSITE), owned by ARISTOCRAZY S.A., with registered office at C/ Gran Vía, 40 Bis 3º, 48009 Bilbao, Spain, with Tax Identification Number (CIF) A48231146, registered in the Mercantile Registry of Vizcaya in Volume 1959, Folio 170, Page 3970A, Entry 8 (hereinafter, ARISTOCRAZY), to customers with delivery addresses in Spain, Andorra, Gibraltar, or Portugal. For sales outside Spain, Andorra, Gibraltar, Puerto Rico, and Portugal, the international online sales conditions shall apply.
The use by the customer of the services offered on the WEBSITE implies, in all cases, acceptance of these Particular Conditions of the Online Purchase Contract, in the version published by ARISTOCRAZY, at the time of the purchase order. Therefore, it is advisable for the customer to read these Particular Conditions before proceeding with a purchase, as well as the general terms and conditions of use of the portal.
We also ask you to read our Privacy Statement before placing your order. By using this WEBSITE or placing an order through it, the customer consents to be bound by these Conditions and our Privacy Statement, so if you do not agree with all the Conditions and the Privacy Statement, you should not place any order.
2. Subject matter of the contract
These particular online purchase conditions apply to the purchase of any product available on the WEBSITE made by customers with a delivery address in Spain, Andorra, Gibraltar, Portugal, Puerto Rico and United States.
The prices of each piece of jewellery, watch, accessory and perfume are shown on the website at the time of placing the order. Prices are detailed for each item including taxes and duties. The cost of shipping and any other services is also specified and will be indicated to the customer in a breakdown when placing the order.
The purchase service through the WEBSITE regulated in these Particular Conditions only allows the purchase of products and services by customers aged 18 or over with a delivery address in Spain, Andorra, Gibraltar, Portugal, Puerto Rico and United States..
ARISTOCRAZY reserves the right to cancel a customer’s access account if fraudulent, speculative or bad-faith acts are detected in the use of this service.
ARISTOCRAZY will modify and update, if it deems it appropriate, articles and prices in accordance with the company's commercial criteria, although changes will not affect products that have already been accepted.
All product orders are subject to availability. If supply difficulties arise, or if items are out of stock, we reserve the right to offer substitute products of equal or greater quality and value. If you do not wish to order these substitute products, we will refund any amount you may have paid.
3. Online purchase process
The information and details contained on the website do not constitute an offer to sell, but rather an invitation to do business. No contract exists between you and ARISTOCRAZY regarding any product until the order has been expressly accepted by ARISTOCRAZY (even if your account has already been charged). If the offer is not accepted and your account has already been charged, the full amount will be refunded.
To place an order, you must follow the online purchase procedure and click "Place Order." Afterward, you will receive an email acknowledging receipt of your order (Order Confirmation). Please note that this does not mean your order has been accepted, as it merely constitutes an offer to ARISTOCRAZY to purchase one or more products. All orders are subject to acceptance by ARISTOCRAZY, which will confirm such acceptance by sending an email informing you that the product is being shipped (Shipping Confirmation). The contract for the purchase of a product between ARISTOCRAZY and the customer (Contract) will only be formalized when the Shipping Confirmation, along with its corresponding invoice, is sent to the customer.
Only those products listed in the Shipping Confirmation will be subject to the Contract. ARISTOCRAZY will not be obligated to supply any other product that may have been ordered by the customer until its shipment is confirmed in a separate Shipping Confirmation.
There may even be exceptional circumstances that require ARISTOCRAZY to refuse to process an order after the Order Confirmation has been sent. ARISTOCRAZY reserves the right to do so at any time, at its sole discretion.
4. Payment methods
The price of the products will be as stipulated on the WEBSITE at any given time, except in cases of obvious error. Although ARISTOCRAZY strives to ensure that all prices displayed on the WEBSITE are correct, errors may occur. If ARISTOCRAZY discovers an error in the price of products ordered by a customer, ARISTOCRAZY will inform the customer as soon as possible and offer the option of reconfirming the order at the correct price or canceling it. If ARISTOCRAZY is unable to contact the customer, the order will be considered canceled and any amounts paid will be fully refunded.
ARISTOCRAZY is not obligated to supply products (even if a Shipping Confirmation has been sent) if the pricing error is obvious and unambiguous and could reasonably have been recognized by the customer as an incorrect price.
ARISTOCRAZY product prices may vary, but (except as stated above) any changes will not affect orders for which a Shipping Confirmation has already been sent.
Due to the nature of online shopping, the product prices displayed on the WEBSITE refer solely and exclusively to purchases made through the WEBSITE and may not match the retail price in ARISTOCRAZY stores. Therefore, the price displayed on the WEBSITE is only binding for online purchases and in no way binds ARISTOCRAZY stores.
Website prices include VAT but exclude shipping costs, which will be added to the total amount due and itemized for the customer.
Once the customer has finished shopping, all the items they wish to purchase will be added to their shopping cart, and the next step will be to process the order and make the payment. To do this, the customer will follow 6 steps:
- They will click on "My Bag" at the top of the page to add the products they wish to purchase.
- Then they will click on "Shop."
- They will fill in and verify their contact information, order details, and the address where they want the order delivered or the store where they want it picked up.
- They will choose their preferred payment method (credit card or PayPal) and enter the corresponding information.
- They will accept the "Terms and Conditions."
- They will confirm the purchase by clicking "Place Order."
The customer can pay with major credit cards, PayPal, or in installments through KLARNA. To minimize the risk of unauthorized access, they will be redirected to the virtual payment gateway/PayPal screen, which will authorize payment for the order.
ARISTOCRAZY uses Verisign to ensure that the payment has been processed securely.
Credit cards will be subject to verification and authorization by the issuing bank. If the bank does not authorize the payment, ARISTOCRAZY is not responsible for any delays or non-delivery, and ultimately, for not being able to finalize the sales contract with the customer.
Value Added Tax (VAT)
5. Shipment
All shipments cost $10.
Free shipping on orders over $125.
Shipments are made via USPS and take 5 to 7 business days, depending on shipping volume and weather conditions.
(*) These delivery times may be extended up to 45 days for some of the following reasons:
- Product customization
- Special items
- Unforeseen circumstances not attributable to ARISTOCRAZY
- Product out of stock
If for any reason we are unable to meet the delivery date, we will inform you of this and you will be given the option to proceed with the purchase by setting a new delivery date or to cancel the order for a full refund. Please note that deliveries are not made on Saturdays, Sundays, or public holidays.
For the purposes of these Terms and Conditions, delivery shall be deemed to have taken place, or the product(s) shall be considered delivered, upon signature of receipt at the agreed delivery address.
Online orders for in-store pickup will have a delivery timeframe of approximately 3 to 4 business days and will be delivered directly to the ARISTOCRAZY stores specified at checkout or order confirmation. In these cases, delivery to a specific address will not be available. The product collection period in these cases is 15 days; after this period, the product will be returned to the warehouse and the amount paid will be refunded.
The risk of loss or damage to the Products passes to the customer upon delivery.
The customer will acquire ownership of the products upon receipt of full payment of all amounts due in relation to them, including shipping costs.
In the event that customs holds the package, the recipient will be responsible for paying the processing costs. This condition is accepted upon purchase. If the item arrives at its destination and the customer refuses to pay the customs and processing fees, this amount will be deducted from the product refund.
Your order may be shipped from different warehouses. If this occurs, we will notify you by email which items you will receive in each shipment.
6. Return
The return period is 30 days.
Customers can return any product free of charge.
Refunds to the original payment method: You can request a refund up to 15 days after receiving your order. Once we receive the item in our warehouse, we will process the refund to the original payment method within a maximum of 15 days.
Available at Aristocrazy stores in Puerto Rico or the United States.
Once the return has been formalized and the item returned along with its original packaging, the refund will be processed as soon as possible, and in any case, within fourteen calendar days of Aristocrazy receiving notification of the customer's return.
All payments received will be refunded, including any delivery costs. The refund will be issued via the same payment method used for the original purchase.
Under no circumstances will exchanges of perfumes be accepted if they have been unsealed after delivery, are not in perfect condition, or have been opened or used, unless the purchased product has some kind of flaw or defect.
Returns via Store Credit
In cases where the product was purchased as a gift, and the recipient wishes to exchange it, the procedure is as follows:
Within thirty (30) days of receiving the product, the recipient must contact ARISTOCRAZY at puertorico@aristocrazy.com. At that time, they must provide the order number shown on the delivery note and their preferred return method: they can drop it off at any ARISTOCRAZY store or arrange for it to be picked up from another location.
Once the product arrives at ARISTOCRAZY, an exclusive online gift voucher will be sent via email to the interested party so that they can make a new purchase in the online store within 1 year.
7. Garantía
ARISTOCRAZY ofrece a sus clientes productos y servicios de la más alta calidad.
El oro utilizado para la fabricación de las piezas es de primera ley de 750 milésimas (18 quilates), de 375 milésimas (9 quilates), la plata de primera ley de 925 milésimas y el platino de primera ley 950 milésimas.
ARISTOCRAZY compra directamente los diamantes en el lugar de origen. Los diamantes ARISTOCRAZY van acompañados de su certificado GIA y se cumplen las condiciones del “Tratado de Kimberley” (sistema de certificación para el comercio internacional de los diamantes no procedentes de países en conflicto).
Dadas las especiales características de los productos comercializados por ARISTOCRAZY en su sitio web, existen ligeras diferencias entre cada producto o servicio adquirido, debido, fundamentalmente, en la singularidad y exclusividad de todos y cada uno de los materiales y piedras utilizados en su confección que es, además, en gran medida, artesanal. Por ello, no hay dos productos o servicios ARISTOCRAZY exactamente iguales y, en todo caso, es inevitable que el producto entregado al cliente difiera ligeramente del mostrado en las fotografías incluidas en el proceso de compra del sitio web (incluso aunque hubiera sido el mismo). En ningún caso, estas diferencias implicarán la entrega de productos o servicios con peor calidad de materiales que los mencionados expresamente en el Portal. Asimismo, el cliente queda informado y es consciente de que el tamaño de las fotografías contenidas en el Portal no se corresponde con el tamaño real de los productos ARISTOCRAZY ofrecidos.
Por ello, el cliente queda informado y consiente expresamente a estas circunstancias y diferencias, sin que las mismas puedan ser causa de resolución del Contrato.
En todo caso, sin perjuicio de lo establecido al comienzo del apartado, los productos ARISTOCRAZY adquiridos por el cliente mediante el procedimiento de compra establecido en el SITIO WEB cuentan con la garantía legal propia de los bienes al consumo, esto es, su conformidad con su descripción en el SITIO WEB y con estas Condiciones Particulares.
ARISTOCRAZY responde de las faltas de conformidad que se manifiesten en un plazo de tres años desde la entrega. El consumidor deberá informar al vendedor de la falta de conformidad en el plazo de dos meses desde que tuvo conocimiento de ella. El incumplimiento de dicho plazo no supondrá la pérdida del derecho al saneamiento que corresponda, siendo responsable el cliente, no obstante, de los daños o perjuicios efectivamente ocasionados por el retraso en la comunicación. En todo caso, queda excluida la garantía relativa a aquellos desperfectos ocasionados por un uso inadecuado, así como en general todas aquellas excluidas por la legislación de la Unión Europea vigente.
8. Basic care
There are a few simple care tips that will extend the life of your ARISTOCRAZY jewelry. For example, we suggest removing your ARISTOCRAZY jewelry before engaging in activities that could damage it, such as exercising. Try to avoid contact between your ARISTOCRAZY jewelry and cosmetics or household products, as these sometimes contain ingredients that can tarnish the color of your jewelry.
To clean your jewelry, use the Official Aristocrazy Polishing Cloth and check the clasps frequently.
Do not expose ARISTOCRAZY jewelry to sudden temperature changes. For proper preservation, it is best to store your ARISTOCRAZY pieces individually. If you use a jewelry box, keep them in a separate compartment from other pieces. Keep chains closed and laid flat to prevent tangling.

9. Customer service

ARISTOCRAZY does not cover shipping costs to after-sales service if the warranty has expired.
10. Competent jurisdiction and applicable law
The use of our website and product purchase agreements using the website shall be governed by local legislation of United States of America.
Any dispute that arises or relates to the use of the website or the contracts in question shall be subject to the non-exclusive jurisdiction of the courts and tribunals of the Client's domicile.
11. ntellectual property and property
All content (including graphic design, source code, logos, text, graphics, illustrations, photographs, trade names, trademarks, and any other elements appearing on the WEBSITE), unless expressly stated otherwise, is the exclusive property of ARISTOCRAZY or third parties.
No intellectual or industrial property rights are granted to the client over the WEBSITE or any of its constituent elements. The client is expressly prohibited from reproducing, transforming, distributing, publicly communicating, making available, extracting, reusing, forwarding, or using in any way, by any means or procedure, any of these elements, except where legally permitted or authorized by the holder of the corresponding rights.
The client may view and obtain a temporary private copy of the content for their exclusive personal, private, and non-collective use on their computer systems (software and hardware), provided that it is not for the purpose of carrying out collective, commercial, or professional activities. The customer must refrain from obtaining, or attempting to obtain, the content by any means or procedures other than those made available to them or indicated for that purpose, or those commonly used on the Internet (provided that the latter do not pose a risk of damage to or disablement of the WEBSITE). The customer must at all times respect all intellectual and industrial property rights relating to the WEBSITE, owned by ARISTOCRAZY or third parties.
In any case, ARISTOCRAZY reserves the right to modify, at any time and without prior notice, the presentation and configuration of the WEBSITE, as well as these Terms and Conditions.
12. Availability of the online purchase service
The Service will be available 24 hours a day. ARISTOCRAZY informs the buyer that anomalies or interruptions in the availability or operation of the Service may occur due to causes beyond ARISTOCRAZY's control (technical problems of Internet providers, telecommunications, problems with the buyer's terminal, etc.), therefore the purchase period may be extended.
13. Special conditions Piercing Studio
To get your piercing with us, you must make an appointment, be at least 18 years old, and bring your ID on the day of your appointment. Please arrive five minutes early to complete the necessary consent forms and purchase the jewelry. The piercing does not include changing the jewelry once the piercing has healed or at any other time.
14. Digital Gift Cards
Digital gift cards purchased as a product on the website do not expire. They can be used at any time to purchase products available in the online store, in accordance with these conditions.
Gift cards are non-refundable, do not accrue interest, and cannot be exchanged for cash. The balance can be used in full or in part in one or more purchases until it is depleted.
In the event of unauthorized use of the gift card code, or access to it by third parties for reasons not attributable to ARISTOCRAZY, ARISTOCRAZY will not be liable for the redemption. The cardholder is responsible for the safekeeping and confidentiality of the code received by email.
These terms and conditions apply exclusively to gift cards purchased as a product on the website, without prejudice to the specific conditions applicable to vouchers or store credits issued as a result of returns, which may be subject to a different validity period as indicated in these General Terms and Conditions.
